These terms apply when you use phenomjiujitsu.com, submit an enquiry, book an intro class, or train at Phenom Brazilian Jiujitsu LLC (“Phenom”, “we”, “us”). Using the site or training with us means you accept them. Please read section 7 carefully — jiu-jitsu and Muay Thai are contact sports and carry real risk of injury.
1. Who we are
Phenom Brazilian Jiujitsu LLC is a martial arts academy operating in Orange County, California, founded in 2014. Our main academy is at 16782 Von Karman Ave, Unit 22, Irvine, CA 92606, with a second location at 22661 Lambert St, Suite 207, Lake Forest, CA 92630. You can reach us at (657) 210-1615 or info@phenombjj.com.
2. Using this website
You may use this site to learn about our programs, view the schedule and contact us. You agree not to interfere with the site, attempt to gain unauthorised access to it, submit false contact details on our forms, or use automated tools to scrape or submit to it.
We work to keep the schedule, pricing and program information on this site accurate, but it may change. Class times in particular are subject to change — see section 4. Nothing on this site is an offer of a guaranteed price or place in a class until we confirm it with you directly.
3. Enquiries and booking an intro class
When you submit an enquiry or intro-class form we collect your name, phone number and email address, and the program you are interested in, so we can contact you and place you in the right group. How we handle that information is set out in our Privacy Policy.
- A booked intro class is a reservation, not a membership, and carries no obligation to join.
- Please arrive around 15 minutes early for your first class so we can complete your paperwork.
- Every student, including intro students, must complete a signed waiver before stepping on the mat. For a minor, a parent or legal guardian must sign.
- If you cannot make a booked class, let us know so we can offer the slot to someone else.
- We may need to move or cancel a booking. If we do, we will contact you using the details you gave us and offer an alternative.
4. Class schedule and closures
The timetable on this site reflects our regular week and can change. We close for public holidays, occasional seminars and competition weekends, and we may combine or cancel a class when a coach is unavailable or attendance is very low. Changes and closures are announced in the academy, on our Instagram and to our school updates list. A cancelled class does not extend or refund a membership period unless we say otherwise.
5. Memberships, payments and cancellation
Memberships, class packs and drop-in fees are governed by the specific agreement you sign when you enrol, together with these terms. Where the two conflict, your signed membership agreement takes precedence. Membership sign-up, billing and cancellation are handled through our membership system, Zen Planner.
- Recurring memberships bill automatically on their renewal date using the payment method on file until cancelled in line with your agreement.
- Cancellation and freeze requests must be made in writing, by email to info@phenombjj.com or in person, and take effect according to the notice period in your agreement. Telling a coach on the mat is not sufficient notice.
- Fees for a period already started are generally not refundable, and unused classes do not roll over or carry a cash value.
- Failed or declined payments may pause mat access until the balance is settled.
- We may change fees with reasonable advance notice to current members.
6. Health and fitness
You should be in good general health before training, and you agree to tell us about any injury, medical condition, pregnancy or medication that could affect your safety or that of your training partners. If you are unsure whether you are fit to train, speak to a doctor first. We are coaches, not medical professionals, and nothing we say is medical advice.
Tell a coach immediately if you are injured or feel unwell during a class. Do not train with an open wound, a skin infection or a contagious illness.
7. Assumption of risk
Brazilian Jiu-Jitsu and Muay Thai are physical contact activities. Training involves close grappling, striking drills, throws, takedowns, joint locks, chokes and live sparring with partners of varying size, strength and experience. You understand and accept that these activities carry an inherent risk of injury — including bruises, cuts, sprains, strains, dislocations, broken bones, dental and eye injuries, concussion, skin infection, and in rare cases serious or permanent injury or death — and that this risk cannot be eliminated however carefully a class is run.
You choose to train voluntarily and you assume that risk on your own behalf, or on behalf of the minor you are enrolling as their parent or legal guardian.
8. Waiver and release of liability
Before training you will be asked to sign our waiver, release of liability and code of conduct. That signed document governs your participation alongside these terms. Our training partner optionality and code of conduct policy is published here.
9. Academy rules and conduct
The mat only works if everyone looks after each other. While at either academy you agree to:
- Follow coach instruction at all times, and stop immediately when told to stop.
- Train at a level appropriate to your partner, and respect a partner declining a roll or a specific technique.
- Tap early and honour a partner's tap instantly.
- Arrive clean, in appropriate attire, with short nails and no jewellery.
- Keep off the mat with shoes on, and keep footwear on off the mat.
- Treat coaches, staff, students and visitors with respect, regardless of belt or experience.
Harassment, intimidation, deliberately injurious behaviour, training under the influence of alcohol or drugs, instructing without authorisation, or filming people without their consent are not tolerated. We may suspend or end membership for conduct that puts others at risk or damages the academy, without refund. Parents and guardians are responsible for the behaviour of children they bring to the academy, including siblings who are not training.
10. Minors, parents and guardians
Our kids program serves children aged 4 to 12. All enquiries, bookings, waivers and membership agreements for a minor must be made and signed by a parent or legal guardian, who accepts these terms on the child's behalf. Children must be collected promptly after class, and must be supervised by their adult whenever they are in the building but not on the mat. This website is intended for adults, not for use by children.
11. Photography, video and media
We sometimes photograph or film classes, gradings and events for the academy's own use, including our website and social media. If you prefer not to appear, tell us in writing and we will do our best to keep you out of frame and will remove you from anything already published on our own channels on request. Students and visitors may not film or photograph other people at the academy without their agreement, and may not post footage of another student without their permission.
12. Personal property
Please do not leave valuables unattended. We provide changing space and locker areas as a convenience, and we are not responsible for loss of or damage to personal property brought to either academy, however caused, except where the law does not allow us to exclude that responsibility.
13. Text messages and email
If you tick the consent box on one of our forms, you agree that we may contact you by phone, text message or email about classes and schedules. Message frequency varies, and message and data rates may apply depending on your carrier. Reply STOP to any text to stop receiving texts, or HELP for assistance. You can unsubscribe from emails using the link in any message. Opting out of marketing does not stop essential messages about a class you have already booked or about your membership.
14. Intellectual property
The Phenom name and logo, and the text, photography, video and design on this site, belong to Phenom Brazilian Jiujitsu LLC or are used with permission. You may view and share pages for your own personal, non-commercial use. You may not copy, republish or use our content, branding or photography commercially, or in a way that suggests we endorse you, without our written permission.
15. Third-party services and links
Parts of this site rely on third parties, each operating under its own terms and privacy policy: StudioProfitOS for membership, sign-ups and the intro-class calendars, Google Maps for the embedded maps, Google Fonts for typography, and Instagram and YouTube if you follow a link to our profiles. We do not control those services and are not responsible for their content or practices.
16. No guarantee of results
Progress in martial arts depends on your attendance, effort, health and individual ability. We do not promise any particular result, rate of improvement, belt, competition outcome or fitness change. Belt promotions are at the discretion of the head instructor and are not purchased with membership or granted by time served alone.
17. Disclaimers
This website is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free or free of harmful components, and we do not warrant that information on it is complete or current. Information on this site is general and is not medical, legal or professional advice.
18. Limitation of liability
To the fullest extent permitted by California law, and except for liability we assume in a signed waiver or membership agreement, Phenom Brazilian Jiujitsu LLC and its owners, coaches, staff and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising out of your use of this website. Where liability cannot be excluded, our total liability relating to your use of this website is limited to the amount you have paid us in the twelve months before the claim.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for gross negligence, fraud, or wilful misconduct, or any right you have under California law that cannot be waived.
19. Indemnity
You agree to indemnify Phenom Brazilian Jiujitsu LLC against claims, losses and reasonable costs arising from your breach of these terms, your breach of the academy rules in section 9, or injury or damage you cause deliberately or through reckless conduct at either academy.
20. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Orange County, California, and you and we agree to the jurisdiction of those courts. If any provision of these terms is found unenforceable, the rest continues to apply.
Before starting a formal claim, please contact us at info@phenombjj.com — most issues are resolved with a conversation.
21. Changes to these terms
If we change these terms we will update the date at the top of this page. Material changes affecting current members will be communicated by email. Continuing to use the site or train with us after a change means you accept the updated terms.
